End User License Agreement (EULA) for MongoBongo
This End User License Agreement ("EULA") is a legal agreement between you ("you", "User") and Sundrysoft governing your use of the Software. By installing, accessing, or using the Software, you agree to be bound by this EULA. If you do not agree, do not install or use the Software.
1. License grant
Subject to your compliance with this EULA, Sundrysoft grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Software on Android devices that you own or control, solely for your personal or internal business purposes.
Certain features of the Software ("Pro Features") may require an active paid subscription or a one-time purchase ("Pro License") obtained through Google Play. Your right to access Pro Features is conditional on the entitlement remaining valid in Google Play.
2. Restrictions
You may not, and may not permit any third party to:
- copy, modify, translate, or create derivative works of the Software, except as permitted by applicable law;
- reverse engineer, decompile, or disassemble the Software, except to the extent such restriction is prohibited by applicable law;
- rent, lease, lend, sell, sublicense, distribute, or otherwise transfer the Software to any third party;
- remove, alter, or obscure any proprietary notices in the Software;
- circumvent or attempt to circumvent any feature gating, license verification, billing, or trial mechanism;
- use the Software to violate any law, infringe any third party's rights, or interact with any system or data you are not authorized to access.
3. Ownership
The Software is licensed, not sold. Sundrysoft retains all right, title, and interest in and to the Software, including all intellectual property rights. No rights are granted to you other than those expressly stated in this EULA.
4. Third-party services and your data
The Software is a client tool that connects to MongoDB servers and other systems that you choose and configure. You are solely responsible for:
- the lawfulness of any data you access, transmit, modify, or delete through the Software;
- securing your credentials, SSH keys, and exported backup files;
- complying with the terms, policies, and access controls of any service you connect to (including MongoDB Atlas and any SSH host);
- any consequences resulting from operations you perform, including data loss, data corruption, unauthorized access, or service disruption on the systems you connect to.
The Software may transmit data to third-party services as described in the Privacy Policy (Google Play Billing for purchases, public DNS resolvers for SRV lookups, and any MongoDB or SSH server you configure). Sundrysoft is not responsible for these third-party services or their availability, security, or terms.
5. Purchases, subscriptions, and trials
All purchases are processed by Google Play, which is the merchant of record. Subscriptions, trials, refunds, taxes, and renewals are governed by your agreement with Google. Sundrysoft does not store your payment information.
Free trials, if offered, automatically convert to paid subscriptions unless cancelled before the trial ends, in accordance with Google Play's policies. You can manage and cancel subscriptions at any time in the Google Play subscriptions settings.
Sundrysoft may change the price, features, or availability of paid plans at any time. Existing entitlements will be honored until the end of the then-current billing cycle.
6. Updates
Sundrysoft may release updates to the Software at its discretion. Updates may add, change, or remove features. This EULA applies to all updates unless a separate license accompanies the update.
7. Disclaimer of warranties
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SUNDRYSOFT DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
SUNDRYSOFT DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT IT WILL OPERATE CORRECTLY WITH ANY PARTICULAR MONGODB SERVER VERSION, ATLAS CONFIGURATION, NETWORK, OR DEVICE.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL SUNDRYSOFT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OR CORRUPTION OF DATA, LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF GOODWILL, COST OF SUBSTITUTE SOFTWARE OR SERVICES, OR ANY OTHER LOSSES, ARISING OUT OF OR RELATED TO THIS EULA OR YOUR USE OF (OR INABILITY TO USE) THE SOFTWARE, EVEN IF SUNDRYSOFT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
WITHOUT LIMITING THE FOREGOING, SUNDRYSOFT HAS NO LIABILITY FOR:
- any data loss, data corruption, accidental deletion, or unintended modification on any MongoDB server, GridFS bucket, or other system you connect to through the Software;
- any unauthorized access resulting from your handling of credentials, exported backups, or device security;
- any consequence of running queries, aggregation pipelines, shell commands, or admin commands through the Software;
- any service interruption, downtime, or unavailability of the Software or its dependencies;
- any conduct or content of any third party, including the operators of any service you connect to.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SUNDRYSOFT'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THIS EULA AND THE SOFTWARE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SUNDRYSOFT (VIA GOOGLE PLAY) FOR THE SOFTWARE IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIVE U.S. DOLLARS (USD $5.00).
These limitations apply regardless of the form of action, whether in contract, tort (including negligence), strict liability, or otherwise.
9. Indemnification
You agree to defend, indemnify, and hold harmless Sundrysoft from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use or misuse of the Software, (b) your violation of this EULA, (c) your violation of any law or third-party right, or (d) any data you access, transmit, modify, or delete through the Software.
10. Termination
This EULA is effective until terminated. It will terminate automatically without notice if you fail to comply with any term. Upon termination, you must stop using the Software and uninstall all copies. Sections 2 (Restrictions), 3 (Ownership), 4 (Third-party services and your data), 7 (Disclaimer), 8 (Limitation of liability), 9 (Indemnification), and 11 (Governing law) survive termination.
11. Governing law and disputes
This EULA is governed by the laws of the State of Oklahoma, United States of America, without regard to its conflict-of-laws principles. The exclusive venue for any dispute arising out of or related to this EULA shall be the state and federal courts located in Tulsa County, Oklahoma, and you consent to the personal jurisdiction of those courts.
If any provision of this EULA is held unenforceable, the remaining provisions remain in full force and effect.
12. Entire agreement
This EULA, together with the Privacy Policy and any terms presented by Google Play in connection with a purchase, constitutes the entire agreement between you and Sundrysoft regarding the Software, and supersedes any prior or contemporaneous agreements regarding the same subject matter.
